Privacy Policy
Inspira Development (Insignia) Ltd. and its parents, subsidiaries, related companies and affiliates (“Inspira Development”) are committed to protecting the personal information of our clients, customers, and business partners.
The term “personal information” when used in this privacy policy means information about an identifiable individual or as otherwise defined by law but does not include contact information which is information that would enable an individual to be contacted at a place of business and includes name, position name or title, business telephone number, business address, business email or business fax number.
This privacy policy applies to personal information that is collected, used or disclosed by Inspira Development (or service providers on behalf of Inspira Development) as set out in more detail in this policy.
Policy 1 – Collection of Personal Information
1.1 Inspira Development collects personal information for the following purposes (“identified purposes”):
(a) to verify identity;
(b) to meet regulatory requirements and comply with all applicable laws;
(c) to establish and maintain commercial relations and provide services;
(d) to provide customers and clients with information related to ongoing and upcoming projects of Inspira Development including by contacting customers using the contact information that was provided;
(e) to develop, enhance, market or provide products and services to customers including contacting customers for these purposes using any contact information that was provided to Inspira Development;
(f) to operate and maintain this website; and
(g) to facilitate the business operations of Inspira Development including administration and employment matters.
1.2 When required by law, Inspira Development shall specify the identified purposes at or before the time personal information is collected. Upon request, persons collecting personal information shall explain these identified purposes or refer you to a designated person who shall explain the purposes.
1.3 Unless permitted or required by law, Inspira Development shall not use or disclose for any new purpose personal information that has been collected without first identifying and documenting the new purpose and obtaining your consent.
1.4 Inspira Development may collect, use and disclose include:
Basic technical information about visitors to the Inspira Development web site, including the gateway from which you have accessed the site and the pages you view.
“Cookies” to enable Inspira Development to register you for access to certain parts of its web site, to identify unique users, and track usage.
Email or other contract information to distribute marketing materials of Inspira Development, including for upcoming projects.
Personal information required to respond to requests for information and services, facilitate communications, conduct market research, verify your identity and/or improve security features.
Information required for Inspira Development to comply with any legal or regulatory requirement.
Credit information, billing records, service, and any recorded complaints.
Policy 2 – Consent
2.1 Inspira Development will obtain your consent to collect, use or disclose personal information except where authorized to do so without consent under applicable laws.
2.2 In obtaining your consent and when required by law, Inspira Development shall use reasonable efforts to ensure that you are advised of the identified purposes for which personal information will be used or disclosed.
2.3 Where possible, Inspira Development shall seek consent to use and disclose personal information at the same time it collects the information. Inspira Development may seek consent to use and disclose your personal information after it has been collected, but before it is used or disclosed for a new purpose.
2.4 Inspira Development will require you to consent to the collection, use or disclosure of personal information as a condition of the supply of a product or service only if such collection, use of disclosure is required to fulfill the identified purposes.
2.5 In determining, the appropriate form of consent, Inspira Development shall take into account the sensitivity of the personal information.
2.6 The use of Inspira Development’s web site, products and services constitutes implied consent for Inspira Development to collect, use and disclose your personal information for all identified purposes.
2.7 You may withdraw consent at any time, subject to legal or contractual restrictions and reasonable notice. Depending upon the circumstances, the withdrawal of consent may affect Inspira Development’s ability to provide you with products or services. You should contact Inspira Development for more information regarding the implications of withdrawing consent.
Policy 3 – Limiting Use
3.1 Inspira Development will not use your personal information for direct marketing or to send commercial electronic messages (CAMs) without your consent, unless and only as permitted by the Canadian Anti-Spam Legislation (CASL). You may unsubscribe from receiving marketing communications at any time by following the “unsubscribe” instructions on the electronic communications sent by Inspira Development, or by contacting Inspira Development as set out below.
3.2 Inspira Development collects personal information primarily from you directly, but may collect personal information in appropriate circumstances from third parties.
3.3 Where reasonably necessary, Inspira Development may also collect personal information from sources including credit bureaus, employers or personal references, or other third parties who represent that they have the right to disclose your personal information.
3.4 Inspira Development may disclose your personal information to:
(a) A person who in the reasonable judgment of Inspira Development is seeking the information as your agent;
(b) Another company involved in supplying you with services related to the services provided by Inspira Development;
(c) A company or individual employed by Inspira Development to perform functions on its behalf, such as research or data processing;
(d) Another company or individual for the development, enhancement, marketing or provision of any of Inspira Development products or services;
(e) An agent used by Inspira Development to evaluate your creditworthiness or to collect your account;
(f) A credit reporting agency;
(g) A public authority or agent of a public authority, if in the reasonable judgment of Inspira Development, it appears that there is imminent danger to life or property which could be avoided or minimized by disclosure of the information; and
(h) Third party or parties, where you consent to such disclosure, or where disclosure is permitted by law.
3.5 Inspira Development limits access to your personal information to employees whose duties reasonably so require access.
3.6 Inspira Development shall keep your personal information only as long as it remains necessary or relevant for the identified purposes or as required by law. Depending on the circumstances, where personal information has been used to make a decision about you, Inspira Development shall retain, for a period of time that is reasonably sufficient to allow access by the affected individual, either the actual information or the rationale for making the decision.
3.7 Inspira Development shall maintain practices for information and records retention and destruction which apply to personal information that is no longer necessary or relevant for the identified purposes or required by law to be retained. Such information shall be destroyed, erased or made anonymous.
Policy 4 – Ensuring Accuracy of Personal Information
4.1 Inspira Development will make reasonable efforts to ensure that personal information is accurate and complete where it may be used to make a decision about you or where it is disclosed to another organization.
4.2 You may request a correction to your personal information in order to ensure its accuracy and completeness. A request to correct personal information must be made in writing and provide sufficient detail to identify the personal information and the correction being sought.
Policy 5 – Securing Personal Information
5.1 Inspira Development is committed to ensuring the security of your personal information in order to protect it from unauthorized access, collection, use, disclosure, copying, modification or disposal or similar risks.
5.2 Where possible, we will protect personal information disclosed to third parties by contractual agreements stipulating the confidentiality of the information and the purposes for which it is to be used.
5.3 Our employees, agents or contractors with access to personal information shall be required to abide by this privacy policy.
Policy 6 – Providing Access to Personal Information
6.1 You have a right to access your personal information held by us subject to certain exceptions.
6.2 A request to access personal information must be made in writing and provide sufficient detail to identify the personal information being sought.
6.3 Inspira Development will make the requested information available within 30 business days, or provide written notice of an extension where additional time is required to fulfill the request.
6.4 A fee may be charged for providing access to personal information. Where a fee may apply, we will inform you of the cost and request further direction from you on whether or not we should proceed with the request.
6.5 In certain situations, we may not be able to provide access to all of your personal information. For example, we may not provide access to information if doing so would likely reveal personal information about a third party or could reasonably be expected to threaten the life or security of another individual. Also, we may not provide access to information if disclosure would reveal confidential commercial information, if the information is protected by solicitor-client privilege, if the information was generated in the course of a formal dispute resolution process, or if the information was collected in relation to the investigation of a breach of an agreement or a contravention of a federal or provincial law. If access to personal information cannot be provided, we will provide the reasons for denying access upon request.
6.6 In order to safeguard personal information, you may be required to provide sufficient identification information to permit us to account for the existence, use and disclosure of personal information and to authorize access to the individual’s information. Any such information shall be used only for this purpose.
